Introduction
Standard Essential Patents (SEP) are patents protecting technology and declared as essential to a standard.
In Orbit Intelligence, patents declared by standardization organizations as SEP are tagged and searchable.
Quick reminder about link between patents and standards: Standards cite patents (as background in their technical annexes/amentums), not the opposite. You will find standards names into the "Citing" section of the citations tab of a family.
Two options are available in the tool to search for SEP patents:
- Using the Standard Filter: Available for all users
- Accessing the SEP module: A dedicated module/add-on available through additional subscription
In this article we are covering the first option of SEP search, the Standard Filter.
What further information can be extracted from the SEP dedicated module?
This module, gives access to essentiality analysis where manually-reviewed essential patents are assessed to be Essential or Non-Essential.
Declarations’ data is displayed for all SEP patents declared to the Standard developing organization, mainly ETSI, IEEE and ITU, allowing thus access to information on both assessed and unassessed patents.
For assessed SEPs, detailed analysis on essentiality or non-essentiality decision basis can be extracted and correlated between the relevant patent claim(s) and the corresponding excerpts of the standard specification.

In Orbit Intelligence, patents declared in a standard can be searched directly from the command line or by filtering a list of results.
Filter patents declared in standards
Another way to identify patents declared in standards is to run a search on a specific topic or company and filter in the results
NB: if the Standards section is not visible in your Filter interface, read the article Filters customization to learn how to display this filter.
Once filtered on the Patents declared in standards, it is possible to identify in which standard the patent is declared.
Important note: Having a patent declared in a standard doesn't mean this patent is essential to this standard. Such evaluation needs an expertise and our consulting team can provide you with such an analysis. Searching standards using command line
To identify the presence of standards in any patents in the database, the command STDN=YES can be used.
To search for all patents containing standards of a certain organization, ORG/STDN=ETSI is the command line (Advanced Search > Command line or from the Search History > Command line editor).
Specific standards are also searchable but each organization has his own naming methodology. The following sections will help you identify the right command lines format depending on the standard of interest:
